The story
On september 11,2025 my 10-year-old son, Marcus, sustained a fracture to his arm while participating in recreational activities during recess at his public school. Marcus was playing football in the schoolyard when he slipped and fell on a section of pavement that was visibly cracked and uneven. According to several students who witnessed the incident, the damaged area had existed for some time and had previously been raised as a concern. No warning sign, barrier, or other precaution had been placed around the area. Following the fall, Marcus experienced significant pain and was taken to the school office before being transported for medical treatment, where his arm was diagnosed as fractured.
The family is seeking legal advice regarding the school's potential liability for Marcus's injuries. In particular, they would like to determine whether the school or its staff knew, or reasonably should have known, about the hazardous condition; whether reasonable measures should have been taken to repair, restrict access to, or warn students about the damaged pavement; and whether the school's response following the incident was appropriate. The family is also seeking advice regarding potential compensation for medical expenses, pain and suffering, and any other losses arising from the injury, as well as the evidence that should be preserved, including medical records, photographs of the pavement, witness statements, school maintenance records, and incident reports.
